4. Website Use and User Obligations
4.1 Lawful Purpose: The Website and Services are intended for lawful purposes only. You agree to use the Website and Services only for their intended purposes as described in these Terms.
4.2 User Information: You agree to provide accurate, current, and complete information when using the Website, including when making a Booking or inquiry. You are responsible for maintaining the accuracy of this information. - Use the Website or Services for any illegal or unauthorized purpose.

- Attempt to gain unauthorized access to any portion of the Website, user accounts, computer systems, or networks connected to the Website.
- Upload, post, transmit, or otherwise distribute any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.
- Upload files that contain viruses, corrupt files, or any other similar potentially damaging software or programs.
- Engage in any activity that disrupts, diminishes the quality of, interferes with the performance of, or impairs the functionality of the Website or Services.
- Remove any proprietary notices or labels on the Website or any Content.
- Circumvent or attempt to circumvent any security or access control measures of the Website.
- Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.
- Solicit, collect, or post private information of other users or third parties.
4.4 Access to Property and System: If you request Services at a Service Location, you warrant that you are the owner, a lawful tenant, or have the express permission of the owner or lawful tenant to allow the Service Provider access to the property and the AC system. You are responsible for providing clear, safe, and unobstructed access to the AC system(s) requiring service, including indoor and outdoor units, condensate drains, and thermostats. You must ensure that the work area is free from obstructions, hazardous materials, or conditions that could impede the safe performance of the Services.
4.5 Pets and Occupants: You are responsible for ensuring the safety of our technicians while on your property. This includes, but is not limited to, restraining pets in a secure area away from the work zone for the entire duration of the Service call. You must also inform our technicians of any known health risks or hazards present on the property.
4.6 Disclosure of System Condition: You agree to disclose all known conditions related to the AC system, including any pre-existing issues, prior repair history, modifications, or unusual noises/smells you have noticed. This information is crucial for proper diagnosis and service planning.
4.7 Presence During Service: While not always strictly required for routine maintenance, for repairs or diagnostics, it is highly recommended that you or a designated adult representative be present at the Service Location during the entire duration of the Appointment to answer questions, authorize work, and ensure access. If no authorized person is present, the Service Provider may need to reschedule the Appointment, potentially resulting in a cancellation fee.
5. Booking and Scheduling
5.1 Booking Process: You may be able to book Services through the Website’s interface, by phone, or via email. You will be required to provide necessary contact information, service location details, and a description of the required Service.
5.2 Appointment Confirmation: A Booking is considered confirmed only when you receive explicit confirmation from the Service Provider, which may be via email, SMS, or phone call, specifying the date and time of the Appointment. Until confirmed, a booking request is merely a request.
5.3 Appointment Times: Scheduled Appointment times are estimated arrival windows and are not guarantees of arrival at a precise moment. Delays may occur due to unforeseen circumstances such as traffic, prior job complexities, or emergencies. We will endeavor to notify you as soon as possible of any significant delays. We appreciate your understanding in such situations.
5.4 Rescheduling by User: If you need to reschedule an Appointment, you must notify us as soon as possible. Our policy regarding rescheduling and potential fees is outlined in Section 7.
5.5 Rescheduling by Service Provider: We may need to reschedule an Appointment due to unforeseen circumstances, technician availability, or safety concerns. We will notify you as soon as possible and work with you to find a suitable alternative time. The Service Provider is not liable for any costs or damages incurred by the User due to rescheduling by the Service Provider.
6. Pricing and Payment Terms
6.1 Estimates: The Service Provider may provide an estimate for the cost of Services prior to the Appointment. Estimates are based on the information available at the time and are not guaranteed fixed prices. The final cost may vary depending on the actual time taken, parts required, the complexity of the work, and unforeseen issues discovered during the Service. Any significant deviation from an estimate will be discussed with you before the additional work is performed, whenever possible.
6.2 Diagnostic Fees: In many cases, a diagnostic fee may apply to assess the issue with your AC system, regardless of whether a repair is performed or if the system is deemed unrepairable or not requiring service. This fee covers the technician’s time, travel, and expertise in identifying the problem. The diagnostic fee is typically separate from the cost of any subsequent repairs but may sometimes be waived or applied towards the repair cost at our discretion.
6.3 Repair and Installation Costs: The cost for repairs, installation, or maintenance will include labor charges and the cost of any necessary parts or materials. Labor charges are typically based on an hourly rate or a flat-rate per specific task, as communicated by the technician. The cost of parts will be added to the labor cost.
6.4 Payment Due Date: Payment for Services rendered is typically due in full immediately upon completion of the Service, or as otherwise agreed upon in writing.
6.5 Payment Methods: We accept [List accepted payment methods, e.g., cash, bank transfer, major credit cards (Visa, Mastercard, etc.)]. Specific payment options will be confirmed at the time of booking or by the technician on site.
6.6 Late Payments: If payment is not received by the due date, we reserve the right to charge a late fee and/or interest on the outstanding balance at a rate permitted by law. We also reserve the right to pursue all available legal remedies, including engaging collection agencies, to recover outstanding amounts. You will be responsible for any costs incurred in the collection process, including legal fees and court costs.
6.7 Invoices: An invoice detailing the Services performed, labor costs, and parts costs will be provided upon completion of the work or shortly thereafter.
6.8 Price Changes: Prices for Services and parts are subject to change without prior notice, although we will endeavor to inform you before confirming a Booking if there is a significant price change from previously quoted rates.
7. Cancellations and Rescheduling Policy
7.1 Cancellation by User: If you need to cancel a confirmed Appointment, you must notify us via [Specify acceptable notification methods, e.g., phone, email] as soon as possible.
7.2 Cancellation Fees:
- If you cancel an Appointment with [Specify notice period, e.g., less than 24 hours’] notice, or if you fail to be present or provide access at the scheduled Appointment time (“No-Show”), you may be charged a cancellation fee or the standard diagnostic/trip fee. The amount of this fee will be communicated to you upon booking or in our standard terms.
- Cancellation with sufficient notice (e.g., more than 24 hours’) may not incur a fee, but this is subject to our discretion and scheduling impact.
7.3 Cancellation by Service Provider: The Service Provider reserves the right to cancel or reschedule an Appointment due to unforeseen circumstances, technician illness, equipment failure, safety concerns at the Service Location, or any other reason outside of our reasonable control. In such cases, we will notify you promptly and attempt to reschedule the Service at a mutually convenient time. You will not be charged a cancellation fee if the Service Provider cancels the Appointment.
8. Service Performance and Limitations
8.1 Standard of Care: The Service Provider will perform the Services with reasonable care and skill, in accordance with industry standards. Our technicians are trained professionals equipped to diagnose and address common AC system issues.
8.2 Diagnosis Accuracy: While our technicians strive for accurate diagnoses, the nature of complex mechanical and electrical systems means that initial assessments may not always reveal all underlying issues, especially if components are inaccessible, systems are very old, or multiple parts are failing simultaneously. The diagnosis is based on observable symptoms and testing performed at the time of service.
8.3 Repair Outcomes: We will endeavor to repair your AC system to a functional state. However, we cannot guarantee that every problem can be repaired, especially if the system is severely damaged, obsolete, or requires parts that are unavailable. In such cases, we may recommend alternative solutions, such as system replacement. We do not guarantee the longevity or efficiency of old or deteriorated systems or components.
8.4 Parts and Materials: Parts and materials used for repairs will be new, reconditioned, or compatible replacements, selected based on availability and suitability for the repair. We will use parts we believe are necessary for the repair; specific brands or types of parts may be used based on our inventory and expertise.
8.5 System Integrity: We are not responsible for the failure or malfunction of pre-existing parts, components, or systems that were not directly worked on or replaced during the Service, including but not limited to ductwork, insulation, electrical wiring (outside the unit itself), or plumbing not directly connected to the AC unit’s drainage. We are also not responsible for issues arising from inadequate power supply, voltage fluctuations, or other problems originating outside the AC system inspected or repaired.
8.6 Unforeseen Conditions: If unforeseen conditions are encountered during the Service (e.g., hidden damage, accessibility issues requiring additional work, discovery of code violations), we will stop work and inform you of the condition and any necessary additional work and costs before proceeding. You have the right to decline the additional work, but this may mean the original Service cannot be completed as planned, and charges will still apply for the work performed up to that point and the diagnosis.
8.7 Compliance with Codes: Our Service generally covers the repair or replacement of components within the existing system configuration. Bringing older systems or installations up to current building codes or regulations is typically outside the scope of standard repair Services unless explicitly requested and agreed upon. We are not responsible for existing code violations.
9. Warranties
9.1 Service Warranty: We may offer a limited warranty on the labor performed for specific repairs. The duration and terms of this labor warranty (e.g., 30 days, 60 days) will be communicated to you by the technician or on the invoice. This warranty covers defects in the workmanship of the specific repair performed. It does not cover subsequent failures of other parts of the system, issues arising from pre-existing conditions, user-caused damage, or problems unrelated to the original repair.
9.2 Parts Warranty: Any warranty on parts used is typically the manufacturer’s warranty. The duration and terms of the manufacturer’s warranty vary by part. We will assist you with warranty claims for parts we installed, but the final decision on the claim rests with the part manufacturer. Used or refurbished parts may have limited or no warranty. We do not provide a separate warranty on parts beyond the manufacturer’s warranty unless expressly stated otherwise in writing.
9.3 Exclusions: Warranties do not cover damage or malfunction caused by:
- Abuse, misuse, neglect, or improper operation by the User or third parties.
- Accidents, acts of nature (storms, floods, lightning, etc.), power surges, fire, or other external events.
- Failure to perform regular maintenance as recommended by the manufacturer or Service Provider.
- Tampering, repair, or service performed by persons other than authorized Service Provider technicians.
- Corrosion, wear and tear, or deterioration due to environmental conditions.
- Obstructions or blockages (animal nests, debris, etc.) not caused by our work.
9.4 Important Note: To the maximum extent permitted by applicable law, except for any specific labor warranty explicitly provided in writing for a particular Service, the Service Provider provides the Services on an “as is” and “as available” basis without any express or implied warranties of any kind.
10. Disclaimers
10.1 Website “As Is”: The Website and all Content, materials, and information provided on or through the Website are provided “as is” and “as available” without warranties of any kind, either express or implied. The Service Provider disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and security and accuracy.
10.2 Service “As Is” (with Warranties): While we offer specific limited warranties as outlined in Section 9, beyond those explicit written warranties, the Services are provided “as is.” We do not guarantee that the Services will meet your specific requirements or expectations, that your AC system will operate flawlessly or indefinitely after Service, or that all potential issues will be identified or resolvable during a single Appointment.
10.3 Information Accuracy: While we strive to provide accurate information on the Website regarding Services, tips, or general AC knowledge, this information is for general guidance only. It should not be taken as professional advice for your specific situation. Always consult with our qualified technicians for advice tailored to your AC system’s needs.
10.4 No Guarantee of Results: We cannot guarantee that a repair will fix your system permanently, that an older system will not develop new problems shortly after service, or that a system nearing the end of its life will function reliably. Our aim is to restore functionality based on the current condition of the system and available parts, but future issues can always arise in complex systems.
10.5 Third-Party Links: The Website may contain links to third-party websites or services. These links are provided for your convenience only. We do not endorse, control, or make any representations about these third-party sites or their content, products, or services. Your access and use of any third-party website are solely at your own risk, and you should review their terms and policies.
11. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall the Service Provider, its affiliates, officers, directors, employees, agents, or subcontractors be liable for any direct, indirect, punitive, incidental, special, consequential, or exemplary damages, including, without limitation, damages for loss of profits, revenue, data, use, goodwill, or other intangible losses, arising out of or in connection with:
- Your access to or use of, or inability to access or use, the Website or Services.
- Any conduct or content of any third party on the Website.
- Any content obtained from the Website.
- Unauthorized access, use, or alteration of your transmissions or content.
- Any errors, omissions, or inaccuracies in the Content or Services.
- Damage to your property or premises that is not a direct result of the Service Provider’s gross negligence or willful misconduct during the performance of the Services.
- Pre-existing conditions at the Service Location that were not disclosed or visible.
- Issues arising from the failure of parts or components not replaced or directly worked upon by the Service Provider.
- Damage caused by third parties, pets, or occupants during or after the Service.
- Delays or inability to perform Services due to unforeseen circumstances, force majeure events (see Section 16), or lack of access.
- Damage resulting from the failure of old or deteriorated components after reasonable efforts to repair or maintain them have been made.
- Any diagnostic or repair outcomes that do not meet your expectations, provided the work was performed with reasonable care and skill.
- Any damages exceeding the amount paid by you to the Service Provider for the specific Service giving rise to the liability in the six (6) months preceding the claim.
This limitation of liability applies whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis, even if the Service Provider has been advised of the possibility of such damage. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of these limitations may not apply to you.
If, notwithstanding the foregoing limitations, the Service Provider is found liable for any loss or damage which arises out of or is in any way connected with any of the occurrences described above, the Service Provider’s liability will in no event exceed the total amount paid by you to the Service Provider for the specific, single Service engagement giving rise to the liability, or [Specify a specific low monetary amount, e.g., USD $100], whichever is less.
12. Indemnification
You agree to defend, indemnify, and hold harmless the Service Provider, its affiliates, officers, directors, employees, agents, and subcontractors from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees and court costs) arising out of or relating to:
- Your violation of these Terms or your use of the Website or Services;
- Your negligence or willful misconduct;
- Any claims of property damage, injury, or death occurring at the Service Location that are not directly and solely caused by the gross negligence or willful misconduct of the Service Provider;
- Your failure to disclose hazardous conditions or inadequate access at the Service Location;
- Any third-party claims arising from your actions or omissions related to the Services or the Service Location.
13. Force Majeure
The Service Provider shall not be liable for any failure or delay in performing its obligations under these Terms or in providing Services if such failure or delay is caused by circumstances beyond its reasonable control, including, without limitation, acts of God, fire, flood, earthquakes, storms, pandemic, epidemic, natural disasters, war, terrorism, civil unrest, strikes or labor disturbances, equipment failure, power outages, internet service provider failure, transportation delays, government actions, or the unavailability of parts or materials from suppliers (each, a “Force Majeure Event”). If a Force Majeure Event occurs, the Service Provider will make reasonable efforts to notify you and reschedule the Service as soon as reasonably practicable.
14. Intellectual Property
All content on the Website, including text, graphics, logos, images, service marks, and software, is the property of the Service Provider or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not use, reproduce, distribute, modify, or create derivative works of any content from the Website without the express written consent of the Service Provider.

- Option B (Arbitration): If the dispute cannot be resolved through informal negotiation within [e.g., thirty (30)] days, the Parties agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Website, or the Services shall be settled by binding arbitration administered by [Specify Arbitration Body, e.g., the American Arbitration Association] in accordance with its [Specify Rules, e.g., Commercial Arbitration Rules], and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. 17. Termination
17.1 Termination by User: You may stop using the Website and Services at any time.
17.2 Termination by Service Provider: We may terminate or suspend your access to the Website and/or ability to book Services, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. This is at our sole discretion. We may also discontinue the Website or Services or any part thereof at any time.
17.3 Effect of Termination: Upon termination, your right to use the Website and Services will immediately cease. All provisions of the Terms which by their nature should survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability, shall survive termination. Termination of Services for non-payment or breach of terms does not relieve you of your obligation to pay for Services already rendered.
18. General Provisions
18.1 Entire Agreement: These Terms, together with the Privacy Policy and any other policies or guidelines explicitly referenced herein, constitute the entire agreement between you and the Service Provider regarding the use of the Website and Services, superseding any prior agreements or understandings, whether written or oral.
18.2 Severability: If any provision or portion of these Terms is held by a court of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision or portion shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.
18.3 Waiver: No waiver by the Service Provider of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of the Service Provider to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.
18.4 Assignment: You may not assign or transfer your rights or obligations under these Terms without the prior written consent of the Service Provider. The Service Provider may assign its rights and obligations under these Terms without restriction.
18.5 Headings: The headings in these Terms are for convenience only and shall not affect their interpretation.
